UpTicker Ltd ("UpTicker," "we," "our," or "us") is committed to protecting the privacy and rights of our users in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable UK data protection laws. This Data Deletion Policy outlines how individuals can request the deletion of their personal data and the process we follow to ensure compliance with GDPR.

2. Data Deletion Rights

Under GDPR, individuals have the Right to Erasure ("Right to be Forgotten"), which allows them to request the deletion of their personal data under certain circumstances, including but not limited to:

• The data is no longer necessary for the purpose for which it was collected.

• The user withdraws consent on which the processing is based, and there is no other legal basis for processing.

• The user objects to data processing, and there are no overriding legitimate grounds for processing.

• The data was unlawfully processed.

• The data must be erased to comply with a legal obligation.

 

3. How to Request Data Deletion

Users can request the deletion of their personal data by submitting a request via one of the following methods:

• In-App Request: Users can navigate to the account settings section within the UpTicker app and request deletion.

Requests must include:

• The full name and registered email address associated with the account.

• A clear statement requesting data deletion.

• Verification of identity (if necessary) to prevent fraudulent requests.

 

4. Processing Data Deletion Requests

Once a request is received, UpTicker Ltd will:

1. Acknowledge receipt of the request within 7 business days.

2. Verify the user’s identity (if necessary).

3. Assess the request to determine if any legal or contractual obligations prevent immediate deletion.

4. If the request is valid, delete the data within 30 days from the date of verification.

5. Confirm the deletion with the user upon completion.

If an extension is required due to complexity, we will inform the user within 30 days, explaining the delay and providing an updated timeline (not exceeding 60 days total).

 

5. Exceptions to Data Deletion

We may refuse or delay deletion if:

• Retaining the data is necessary to comply with a legal obligation (e.g., tax, regulatory, or law enforcement requirements).

• The data is required for legitimate business purposes (e.g., ongoing contractual obligations).

• The data is necessary for the establishment, exercise, or defense of legal claims.

• The request is excessive, repetitive, or manifestly unfounded.

In such cases, users will be informed of the reason for refusal and their right to lodge a complaint with the Information Commissioner’s Office (ICO) or another relevant data protection authority.

 

6. Deletion of Backups and Logs

• Personal data stored in active databases will be deleted immediately upon request approval.

• Data in automated backups may take up to 90 days to be fully removed due to system retention policies, but it will not be used or processed further.

• Anonymized data that cannot be linked to an individual may be retained for analytical or operational purposes.

 

7. Third-Party Data Sharing

If personal data has been shared with third-party processors (e.g., cloud storage, analytics providers), UpTicker Ltd will take reasonable steps to notify these parties of the deletion request unless it is technically impossible or requires disproportionate effort.
